General terms and conditions for Newsec transaction application

Welcome to Newsec’s transaction application!

These general term and conditions ("Terms") apply when you create a user account and access news, information and other transactional content available in our transaction application (the "Service") provided by Newsec AS ("Newsec", "we", "us", etc.).

Newsec offers a wide segment of real estate services, including property asset management and advisory services to real estate owners, investors, tenants and other customers of Newsec. As a part of Newsec's digital initiatives, we have developed the Service.

The purpose of the Service is to provide Newsec group’s employees, customers and partners with valuable news and information about e.g. statistics, trends and other content related to the commercial real estate market and transactions in the Nordic and the Baltics, as acquired by Newsec within our day-to-day operations and other third parties with which we cooperate.

By using accessing and using the Service you will get access to all information that we upload and provide in the Service, including a search feature that makes it easy for you to get access to specific real estate data and push notifications when we publish new information and content in the Service that we deem may be of particular interest for our users. You may at any time choose whether to allow push notifications from the Service by adjusting the settings on your device.

1. Acceptance of the Terms

1.1 In order for you to be able to us and access the Service you must create a user profile providing us with your name and email address. In connection with creating a user profile, you agree to our Terms. If you do not accept these Terms, you are not entitled to use the Service. As a user of the Service, you are responsible for the correctness of the information you provide in order to access the Service.

1.2 We encourage you to handle your user information carefully and keep the information to yourself.

2. Use of the Service and access to information

2.1 Your use of the Service and access to the information provided through the Service must take place in a manner that is consistent with these Terms. You are for example solely responsible for ensuring that your use of the Service does not cause damage or other inconvenience to Newsec, third parties and any other users,or is contrary to the law or to authority regulations or decisions. You may not:

  • use the Service to slander, abuse, harass, monitor, threaten or otherwise violate anyone else or their rights;
  • otherwise use the Service for any fraudulent or other illegal purpose;
  • disrupt or take measures to attempt to disrupt the operation of the Service;
  • investigate, modify, adapt, translate, reverse engineer, decompile or disassemble any part of the Service, including with no limitation to its object code or source code;
  • copy, reproduce, sell or otherwise exploit the Service or its content; or
  • transmit or otherwise introduce viruses, worms, trojans or other malicious software or code, or otherwise damage or adversely affect the functionality or availability of the Service.

2.2 Use of the Service in violation of these Terms may be reported to authorities, associations or supervisory bodies.

2.3 Under these Terms, you as a user are granted a personal, non-exclusive, non-transferable, non-sublicensable and limited right to use the Service and access the information published in the Service only in manner such information is presented to you.

2.4 The Service is at any time provided on an as-is basis. Newsec does not guarantee that the Service will always function without disruptions or is free from errors and defects. Furthermore, Newsec is under no circumstances obligated to update the Service or its contents, e.g., with new features or with the latest available information or data. Moreover, Newsec may at its sole discretion from time to time publish, adjust, and remove content or information available in the Service. Newsec cannot guarantee that certain information will be available in the Service.

2.5 Newsec takes no responsibility for the accuracy of, or reliance upon, the information made available to you through the Service. You as a user acknowledge that the information, statistics, content, etc., published in the Service do not form part of Newsec's advisory services. As a user of the Service, you also acknowledge and accept that the Service may from time to time be made unavailable due to planned and/or unplanned downtime for service, maintenance and updates.

3. Personal data

To use and access the Service, you need to create a profile by entering your name and email address. 4. Ownership

Newsec, our group companies, partners, third parties and/or sub-contractors own all intellectual property rights to the contents, information, statistics, etc., made available in the Service, including its underlying technology (as relevant). Nothing in these Terms shall be construed, or understood, as Newsec, our group companies, partners, third parties and/or sub-contractors granting any such intellectual property rights to you as a user, other than necessary for using the Service in accordance with these Terms.

5. Termination and suspension

Newsec has the right, at its sole discretion, to temporarily or permanently suspend or limit your access to and use of the Service (i) in the event of a suspected or actual security incident or technical problem or (ii) if you violate these Terms, laws, regulations, or if you otherwise abuse the Service.

6. Limitation of Liability

Newsec assumes no liability for any damages that may arise from using the Service, or otherwise in connection thereto, except as required pursuant to mandatory law.

7. Changes to the Terms

Newsec reserves the right to make changes to and update these Terms from time to time. Newsec will notify you before we implement significant changes and give you the opportunity to read the revised Terms before you continue to use the Service. If you continue to use the Service after changes have been made, you accept the changed terms. If you do not accept the change, you are not entitled to use the Service.

8. Applicable law

Swedish law applies to these Terms. Disputes arising in connection with these Terms shall be settled by a general court.
